Terms and Conditions
for language training services provided by [Dr. Mark Müller] – www.german-tutor-berlin.de

This English version is provided for convenience only. In case of any discrepancies, the German version shall prevail.

1. Scope of Application
These Terms and Conditions (T&C) apply to all contracts for language training (individual or group lessons) concluded between [your name] (hereinafter “Provider”) and the client (hereinafter “Client”). They apply equally to clients based in Germany and abroad, unless mandatory legal provisions provide otherwise.

2. Conclusion of Contract
A contract is concluded when the Client accepts a written offer from the Provider or explicitly commissions the Provider to conduct language lessons. A booking without a formal offer shall also be deemed a binding agreement, unless otherwise specified.

3. Services
The Provider offers language lessons in German and English, in both individual and group formats. Lessons are held either online or in person in Berlin, depending on prior agreement. The specific contents, objectives, format, and schedule are agreed individually with the Client.

4. Prices and Payment Terms
Unless otherwise stated in a specific offer, the prices listed on the Provider’s website at www.german-tutor-berlin.de shall apply.

Payments are to be made via bank transfer to the account specified on the invoice. The payment term is 14 calendar days from receipt of the invoice. All prices are net unless stated otherwise and may be subject to applicable taxes.

5. Cancellation and Missed Lessons
Lessons may be cancelled or rescheduled free of charge up to 24 hours before the agreed start time.

Cancellations on the same day or no-shows will be charged in full.

In the event of cancellation by the Provider (e.g., due to illness), no fees will be charged. However, there shall be no claim for compensation.

6. Cancellations by the Provider
If a lesson cannot take place due to reasons beyond the Provider’s control (e.g., illness, force majeure), it will be rescheduled by mutual agreement or cancelled without any obligation for payment. Further claims, in particular for compensation, are excluded.

7. Liability
The Provider shall be liable only for intent and gross negligence. In cases of simple negligence, liability shall be limited to breaches of essential contractual obligations (cardinal obligations) and to the typical foreseeable damages.

The Provider assumes no liability for technical disruptions during online sessions that lie outside his sphere of influence.

8. Copyright
All teaching materials provided during lessons are protected by copyright. Rights are held either by the Provider or by the respective publishers. Materials may not be distributed, copied, or published – even in part – without express written permission.

9. Data Protection
Personal data is processed in accordance with applicable data protection laws. Further information is available in the Privacy Policy at www.german-tutor-berlin.de.

10. Place of Jurisdiction
Where legally permissible, the exclusive place of jurisdiction for all disputes arising from this contractual relationship is Berlin, Germany. The laws of the Federal Republic of Germany shall apply.

11. Final Provisions
Should any provision of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by one that most closely reflects its original economic intent.
